Not Guilty Plea Entered by Judge for James Holmes

CENTENNIAL, Co. -- James Holmes, the man accused of gunning down people at a Colorado movie theater will go on trial in August and the presiding judge entered a not guilty plea on his behalf.

Holmes' defense attorneys argued they need more time before entering a plea. The judge, William Sylvester, denied their request and entered a not guilty plea on the behalf of James Holmes. By doing so, the door is now open for the defense to change the plea to not guilty by reason of insanity.

If the defense changes the plea, Holmes will have to undergo a series to mental evaluations to determine if he is insane.

Prosecutors also need to decide if they will pursue the death penalty and have to let the judge know when both sides are due back in court in April.

The 25-year-old faces 166 felony counts for killing 12 and injuring 70 other people during a shooting at a movie theater in Aurora, Colorado in July 2012.

If Holmes is found guilty, he faces life behind bars or death.
