Washington, D.C.-According to the list of cases to be heard by the U.S. Supreme Court next year published Monday, the case on California's Proposition 8 was noticeably missing. Proposition 8 was overturned in California on appeal from same-sex marriage advocates.
Proposition 8 was passed in 2008 by voters declaring Marriage is defined as to be only by a man and woman. This after several same-sex marriages were performed in California. The California 9th Circuit Court of Appeals struck that proposition down in 2010 ruling that it violated due process and equal protection clauses of the U.S. Constitution.
On June 5, 2012, a majority of the full Ninth Circuit denied a petition for a rehearing and stayed the ruling pending appeal. The proposition's proponents filed a petition with the U.S. Supreme Court, requesting that the Court review the case, on July 30, 2012. The petition was scheduled to be considered at the Court's November 30, 2012, conference. The Court took no action on the gay marriage-related appeals.
Court watchers believe that the Defense of Marriage cases will get a hearing before California's Proposition 8 case.
