WATSONVILLE, Calif. - A judge in Santa Cruz says there's not enough evidence to charge a Monterey man with the poisoning death a four-year-old dog.
Judge Stephen Siegel made that statement in an 8-page ruling, published earlier this month and presented today in court.
The dog's owners, James Danaher and Linda Chandler, sued Dan Kidd in small claims court for improperly disposing of antifreeze on a common driveway, which they say killed their dog.
Kidd's wife manages the property where it all happened.
Danaher and Chandler uphold that Kidd is also responsible for the deaths of three other dogs in the same area.
The judge said testimony in the case did not match up with the allegations leveled against Kidd.
