    We have new information on what was believed to be a hot tub drowning, that turned into a full blown child abuse investigation.  A 5-year-old boy found crying and screaming at a beach front hotel in Marina.
    We have new information on what was believed to be a hot tub drowning, that turned into a full blown child abuse investigation.  A 5-year-old boy found crying and screaming at a beach front hotel in Marina.

MARINA, Calif. - A 5-year-old is in a San Jose ICU with major head trauma, and his mother's boyfriend is in jail for alleged neglect.

It all started at the Quality Inn hotel in Marina just after one Tuesday afternoon, when someone called police for a 5-year-old under water, allegedly "passed out."

The boy was flown to a San Jose trauma center, where doctors told Marina Police he had "severe head trauma" caused by abuse and neglect, not from the intake of water from the hot tub.

An investigation led them to Julian Christopher Diggs, of Moss Landing. Diggs was arrested at the San Jose area hospital by Marina Police officers and then transported to the Monterey County Jail where he was booked.

He's in the Monterey County Jail, charged with child endangerment, possession of a controlled substance and violation of probation.

The child remains at the San Jose area hospital in ICU in serious condition with major head trauma.
