TMZ reports that Portwood appeared in court Tuesday morning when her attorney asked for leniency. But the judge was reportedly unmoved and insisted he had no choice but to enforce the terms of Portwood's prior plea agreement.

Portwood's five-year sentence had previously been delayed on condition that she complete a drug rehabilitation program. But Portwood reportedly gave up on the program and asked to go to prison instead.

The judge said he would refer Portwood to the Indiana Department of Corrections program, an incarceration-based treatment and therapeutic community program. Portwood will be given credit for time served in jail.
