SAN FRANCISCO, Calif- If you are stopped at a red light the 1st District Court of Appeal in San Francisco says you still can't talk on your cell phone.
A driver who was fined $103 dollars after being cited for talking on his handheld phone while at a stop light challenged the law claiming he wasn't driving.
The First District Court of Appeal did not agree with his argument.
The San Francisco Chronicle reported that Justice James Lambden said in his ruling the law was intended to cover "persons driving on our public roadways, who, like (Nelson), may pause momentarily while doing so in order to comply with the rules of the road."
A lawyer for the man says he'll appeal to the California Supreme Court.
