A former Carmel doctor was sentenced today to six years in prison after being found guilty of sexual assault. But his attorney Tom Worthington says the Judge's instruction to the jury was incorrect, and wants a new trial.
Judge Russell Scott sentenced Carl Bergstrom to six years in state prison for forcible sodomy. The judge addressed the former doctor, whose medical license has been suspended since his conviction in July. He said Bergstrom was a sexual predator, who will not stop when he wants something, "We're here because you violently sexually assaulted her," Judge Russell Scott.
The judge denied the defense team's motion for a new trial prior to sentencing. During the sentencing hearing this morning, Jane Doe 1 addressed the court and thanked the jury in this case. She said stated she will leave the courtroom with her pride restored, and her head held high knowing the truth had been told and justice was served.
Skeptics during and after the trial continue to bring up suspicions of character in Jane Doe 1," As Jane Doe was reading I saw a number of people over there shaking their heads. That's wrong. There is something very wrong with that," said Judge Scott.
Paul Major spoke with Central Coast News after sentencing and says the Jury was fair, "This was not about what Jane Doe 1 did five years ago, or last year, or anything else. This is about was she attacked. The answer the jury said was yes," said Paul Major.
The Monterey County District Attorney's Office is continuing to investigate other activities involving Bergstrom. Prosecutors told us the defense has filed paper work for a new appeal.
